Rental Agreement

Powell Outdoor Gear Rental seeks to provide those who love the outdoors the gear needed to explore and enjoy our amazing region.  Our mission is to “Provide you the gear you need for an amazing outdoor experience”.  If you do not find the equipment you are looking for on our website, please do not hesitate to contact us and we will see if we can meet your needs.  In addition to providing quality gear rental, we will also provide a delivery service for our rented gear and a service for setting up and taking down camps at your identified location for a separate fee.  Take a look and see what we have to offer. 

Rental Start and Return Date

Your rental start date is after 8:00 a.m. on the first date of pickup. Please bring a photo ID that matches the name on the order or a copy of your order confirmation with you for pickup at Stix Market.  The return date is 5:00 p.m. of the final day of the rental period and gear must be given directly to a Stix employee to confirm the return was received. Gear may be returned before the final day of the rental period but no partial refunds will be given.

Rental Fee

Your charge card will be charged for the amount of the rental plus taxes and services immediately upon your rental order.  In addition, you hereby authorize Powell Outdoor Gear to charge your payment card an amount equal to 100% of the replacement value of items returned damaged or the amount equal to the charges to repair the item(s). An additional cleaning fee of $50 per hour will be charged for cleaning items that are returned wet, muddy or with heavy dirt. For more information on each of these fees, please see below.   

Late Returns

A late fee will be charged for items returned past 5:00 p.m. on the set date of return.  We make commitments for our rental items so it is important to get the equipment returned on time so these commitments can be met.  Late items will be charged at a daily rate that is equal to 1/3 of the 3 day package rental fee. 

Damaged and Stolen Gear

Normal wear and tear is expected with use but we also expect that our gear is returned to us in good condition.  Please understand that damage such as rips, tears, stains, muddy, missing parts, burn holes and dents, etc. are things that the customer will be responsible for and will result in additional charges against your credit card for repair or replacement.  You will be charged to replace gear that was stolen while in your possession.  Once you rent the gear it is your responsibility to get it back to us.  Wind can be an issue in the Four Corners area, especially in the spring.  Instructions must be followed and special care given to ensuring that rented gear is protected against these windy conditions.  This includes setting up tents and monitoring the use of sun shades in windy conditions. 

Reserving Gear

Availability of gear may be limited during our peak season.  You will be contacted if there is a problem with filling your order and every effort will be made to make arrangements to meet your needs.  Please reserve your gear as far in advance as possible.  Two weeks or more for a reservation is great and a one week reservation is nice.  Short notice requests are certainly considered if there is inventory available to support the request. 

Cancellation Policy

If you cancel a reservation with less than a five day advance notice, you will be charged 50% of the reserved rental rate.  Again, commitments and schedules are made around reservations to provide efficient service to those that are looking for our equipment and we need to effectively plan.

Cleaning

You must return gear to us dry and free of mud and heavy dirt.  There is a $50 per hour cleaning fee charged to customers for any additional cleaning required due to your rental.

Communication

You are encouraged to contact us directly at [email protected] or (928) 660-0875 to make inquiries on rental gear inventory or to request an item not listed on the website and we will make every effort to accommodate if possible.  You consent to receive communication from us, including email, text messages and phone calls for the purpose of notifying you about the status of your order, sending you reminders, responding to questions and inquiries and providing other information.

Liability

Powell Outdoor Gear is not responsible for any personal injury resulting while using our gear or while you are in possession of our gear.  It is understood by all that there are inherit dangers associated with the use of our gear during activities associated with camping, hiking, backpacking, water sports and other outdoor activities.  If any item does not work properly or does not work as intended by the gear manufacturer, you agree our maximum liability to you is the rental fee associated with the rented item.  You also understand that there may be unforeseen circumstances that may create conditions where your outdoor experience is negatively impacted.  Powell Outdoor Gear will not assume any financial responsibility related to the quality of use of our gear when impacted by unforeseen circumstances, such as weather.

It is your responsibility to familiarize yourself with the user manuals for each item, to check the items prior to each use, and to use them properly.  Do not use rented gear for purposes other than those for which it is intended by the manufacturer.

You hereby agree to indemnify, defend and hold harmless Powell Outdoor Gear, its owners and employees and agents from and against any and all liabilities, losses, damages, demands, claims, suits, actions, judgments, causes of action, assessments, costs and expenses, including, without limitation, interests, penalties, attorneys’ fees, any and all expenses incurred in investigating, preparing and defending against any litigation, commenced or threatened, or any claim whatsoever, and any and all amounts pain in settlement of any claim or litigation, asserted.
